Designer Nate Berkus plans for baby makes three. The cutie design duo of Berkus (second photo, left) and his partner, Rachel Zoe’s former assistant Jeremiah Brent (right) are reportedly using a surrogate and hoping for a boy. The couple have been together three months.

Obama administration spanks Prop 8. The Justice Department filed a brief with the Supreme Court on Thursday arguing that California’s ban on marriage for gay couples is unconstitutional and names seven other states that should be granted gay marriage laws. The brief stops short of gay marriage in all 50 states. More briefs favoring marriage equality Thursday included Georgia Equality joining a Red State brief, an NFL gay allies filing by Brandon Ayanbadejo and Chris Kluwe, plus briefs filed by everyone from Ellen Degeneres to the American Sociological Association. On Friday, more than 200 Congressional Democrats turned attention back to DOMA.

Lesbian teen suing Florida high school. Amber Hatcher (third photo), who is currently suing her Florida high school after being suspended for participating in the annual “Day of Silence” campaign, is speaking out about how her school principal threatened her, then trampled all over her First Amendment rights.

Man charged in death of gay Mississippi mayoral candidate. Just days after Marco McMillan’s body was found near a highway, the man who later crashed McMillan’s car was charged with his death. McMillan, running for mayor of Clarksdale, Miss., was considered the state’s first viable gay candidate. The cause of death, the nature of the relationship between the men and a possible motive have not been released.

Colorado House Committee advances civil unions. The state House Judiciary Committee easily passed the legislation in an 8-3 bipartisan vote on Thursday. The full body is expected to vote on the measure after two more committee stops considered more weigh stations than hurdles.

The trouble with thruples. Why there is always an odd man out in gay three-ways (fourth photo), and what you can do to wrap your head around why when someone new falls into a bed already occupied by two, one of the three most usually falls right out.

Bill O’Reilly douchey over trans student rights. The Fox News darling calls the very notion “insane” that a Massachusetts schools policy seeks to respect students’ gender identity. Then he steps it up by suggesting some cross-dressing “wise guys” might use the policy to infiltrate the girls’ restrooms.

Lesbian mom beaten unconscious in Texas schoolyard. Sondra Scarber is recovering from injuries she suffered after trying to protect her partner’s four-year-old son from bullies. What began as telling bigger kids “‘Can you please keep your hands off of him, he’s only four,’” became an assault from adults who realized that the women with the boy were a lesbian couple.

“Shameless” twink comes out as straight. Playing gay teen Ian Gallagher for three seasons on the Showtime hit, actor Cameron Monaghan (bottom photo), decided to tweet the answer to his most constant question. “This is the only time I will answer this here: No, I’m not gay. Yes, I play a gay character. No, the question should not be relevant.” Later he added, “Thanks for the kind words, everyone. It feels a bit odd to ‘come out’ as a straight guy.”

What to do when that hot guy is HIV-positive. Some of you are surprised the question still needs answering. Others eagerly anticipate insight that starts with a disclosing guy is safer than a lying one, and advice that begins, “You’ve probably already had sex with a poz guy and didn’t know it.”
